A Federal Mine Safety & Health Review Commission administrative law judge (ALJ) has dismissed the Pattern of Violations (POV) Notice issues to Brody Mining, an affiliate of Patriot Coal Corp.

"We are pleased that ALJ Moran agreed with Patriot's position and overturned MSHA's POV Notice," said Michael Day, executive vice president – operations at Patriot Coal, in response.
Patriot acquired Brody in December 2012. Before that, Brody was owned and operated by an independent company. Many of the issuances cited by MSHA in the POV Notice took place under Brody's prior owner, Patriot Coal said in a press release.
