The Clean Air Act and greenhouse gases

Howard J. Feldman, Director of Regulatory & Scientific Affairs at API, testified at a hearing on 14 September for the Environmental Protection Agency’s GHG Permitting Federal Implementation Plan.

‘The Clean Air Act was not designed to address greenhouse gas emissions,’ said Feldman. ‘Modifying the existing statutory thresholds to make them work for greenhouse gases, as the agency has done, amounts to rewriting the Clean Air Act, not applying it.’

‘Furthermore, applying the Clean Air Act in a way that was never intended by Congress will unnecessarily raise the cost of America’s energy. At a time when the administration should be focused on job creation and economic recovery, this is the last thing it should be pushing through. Let Congress address climate change with new legislation.’
